You have certainly already heard about the new European legal framework applicable in the field of personal data protection. At first glance, things may seem complicated, but they are not, we are here to simplify them.
Starting with May 25, 2018, the European Regulation on the Protection of Personal Data, respectively data belonging to natural persons, will apply. As a general rule, any entity, regardless of the country in which it operates, is obliged to take into account and apply the new requirements, if it uses personal data of natural persons located in the European Union.
We always want to be transparent with you and want to make sure you are well informed about the personal data we collect and the purposes for which it is used.
In short, we want to use the personal data, which you transmit to us or which we collect in the course of our business relationship, to continue to inform you about the latest solutions, services and products adapted to your business, about the most important business events and the latest technologies.
To be able to do this, we need your consent to process this personal data for commercial purposes. and because we know that your time is an important and limited resource, we will contact you in the near future to find out your decision in this regard.
We assure you that we will make every effort to keep the personal data provided in complete security and we will only use it for the purposes permitted by the law and by you.
For us it is very important to inform you in detail about the way in which we will process the personal data to which we have access. Thus, in the following paragraphs, you will find more information about the activities carried out in this regard by our company.
Personal data ("Personal Data"): represents any information regarding an identified or identifiable natural person; an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identification element such as name, identification number, location data, online identifier, or to one or more specific elements , specific to his physical, physiological, genetic, psychological, economic, cultural or social identity.
Operators of personal data ("Operators" or "S.C. CENTRIC IT S.R.L."): S.C. CENTRIC IT S.R.L., based in Cluj, loc. Sannicoara str. Grădinarilor, no. 33, Romania, postal code 407042, no. of order in the Trade Register J12/290/2010, CUI 26548709, subscribed and fully paid-up capital of 200 lei, personal data operator.
Operator-Supplier: is that Operator with whom the Customer would conclude or has concluded one or more Contracts.
Client: The legal person or any form of organization provided by law which, although not declared a legal person by law, has an independent organization and its own patrimony that has concluded or is about to conclude at least one Contract with any of Operators.
Client's representative: that natural person having the capacity of legal representative or authorized representative of the Client in the relationship with CENTRIC IT, in order for the latter to fulfill the legal obligations provided by the legislation in the field of personal data protection and to express consent to the processing of personal data transmitted and collected in consideration of the Contract, for situations in which the expression of such agreement is necessary.
Contract: represents the legal act concluded with one of the Operators, such as those under which the Operator-Provider provides electronic communications services and/or additional services and/or sale/rental of equipment/provision of licenses.
For the purposes of this Information and the Personal Data Processing Agreement, any reference to "Contract" will be understood as indicating all contracts that will be concluded with the Operator-Provider.

Processing of Personal Data: represents any operation or set of operations performed on Personal Data or sets of Personal Data, directly and or indirectly through agents, with or without the use of automated means, such as collection, registration, organizing, structuring, storing, adapting or modifying, extracting, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, deleting or destroying.
The person concerned: the natural person whose Personal Data is the object of the Personal Data Processing and who may be the Client Representative defined above, or any other natural persons within the Client's organization whose Personal Data is provided by the Client to any of the Operators or which can be collected in order to carry out the Personal Data Processing activities, both for its own purpose and in the name and on behalf of its contractual partners, according to the purposes determined by the latter.
Duration of Processing: Personal Data collected by any of the Operators will be processed: (i) during the entire period of execution of the Contract, (ii) after the termination of the Contract, for a period of 3 years, (iii) after the expiration of the 3-year period, in case the retention of the collected Personal Data is necessary in accordance with the applicable legislation in the field, but without exceeding the maximum duration provided by it, or the retention terms provided in the retention policy established at the level of CENTRIC IT. In the case of sending commercial communications, Personal Data will be processed until the date of withdrawal of the consent expressed by the Customer's Representative for this purpose, but no more than 3 years from the date of termination of the Contract or, if the Customer has concluded several Contracts with any of the Operators, from the date of termination of the last Contract.
Categories of Recipients of Personal Data: Personal Data may be communicated, insofar as this is necessary, to the following categories of recipients: (i) debt recovery companies; (ii) companies offering postal/courier services; (iii) software and/or equipment providers; (iv) other subcontractors of the Provider-Operator as well as authorized representatives of CENTRIC IT: (v) providers of outsourced call-center and customer support services, (vi) public authorities (ANCOM, Ministry of Communications and Information Society, National Authority for Consumer Protection etc.); (vii) courts or arbitral tribunals, as well as competent authorities to investigate the commission of criminal acts, at their request, (viii) service providers, contractual partners of the Operators, who offer assistance in order to provide, activate, install, operate, insure maintenance of equipment and services provided by any of the Operators. Also, Personal Data may be communicated to recipients such as: (i) market research companies/customer satisfaction studies; (ii) the contractual partners of any of the Operators, in order to promote the products and services marketed by them, exclusively on the basis of the agreement expressed by the Customer Representative in advance.
Recipient companies that process Personal Data within the European Union/European Economic Area are subject to the same legal provisions and offer the same level of protection as the Operators. However, if for the performance of the Contract it will be necessary to transfer Personal Data to recipients outside the European Union/European Economic Area or to states that do not offer an adequate degree of protection, the Operators will request those recipients to protect the Personal Data in accordance with the requirements of European legislation.
Communication: means any information exchanged or transmitted between a determined number of participants by means of an electronic communications service intended for the public.
The Client is obliged to notify the Operator-Provider in case of any change regarding the person or the Personal Data of the Client Representative as well as any other Person concerned by sending an email to [email protected].
B. The personal data below: a. consumption data, of the services that are the subject of the Contract, b. commercial data (such as the invoice amount, payment methods, payment term and payment history, invoice payment preferences), will be able be processed by the Operator-Provider for the following purposes: a. offering, negotiating, concluding, executing, amending or terminating the Contract, installing, activating and providing services, delivering equipment, providing licenses, invoicing and collection, responses to complaints; b. providing customer relations service, sending information and notifications, offering technical assistance services; e. detecting and preventing fraud when activating and using the services that are the subject of the Contract; h. conducting internal studies and statistics, market studies, etc.
The Personal Data referred to in point II B above may be processed by the Operator-Supplier for the purpose of determining creditworthiness and the degree of debt and fraud risk.
The Operators can process the Personal Data mentioned in points A and B above, exclusively based on the Customer Representative's option expressed in advance, based on the Customer profile, for the purpose of carrying out commercial communications and sending personalized offers for the products and services offered by CENTRIC IT and/or for those offered by their contractual partners, by using the following means of communication: phone calls, letters, electronic correspondence.
In accordance with the legislation in force, the persons concerned benefit from the following rights: a. the right to be informed about the Personal Data processed by the Operators; b. the right to obtain from the Operators confirmation of the fact that they are processing the Data Personal data of the data subject and, if so, access to that data and information such as the purposes of the processing, categories of personal data concerned, recipients or categories of recipients, where possible, expected storage period. If the Personal Data does not are collected directly from the data subject, the source of this data as well as, where applicable, the existence of an automated decision-making process including the creation of profiles; c. the right to rectify inaccurate Personal Data or complete them; d. the right to delete Personal Data, in in accordance with the applicable legal provisions in the field of personal data protection, e. the right to restrict processing when one of the following cases applies: The data subject contests the accuracy of the data, the processing is illegal, the data subject objects to the deletion of the data, when the Operator-Provider or The Operators together no longer need the Personal Data for the purpose of processing, but the Data Subject requests them for the establishment, exercise or defense of a right in court or when the Data Subject opposes the processing, for the period of time in which it is verified whether the legitimate interests of of the Operator-Supplier or of the Operators together prevails over those of the Targeted Person; f. the right to data portability, which consists in the possibility of requesting the Operator to transmit the Personal Data provided by the Data Subject, in a structured format currently used and which can be read automatically, and the transmission by the Data Subject of this data to a other operator; g. the right to object to the processing of Personal Data, at any time, freely and without any justification for situations such as: (i) receiving commercial communications, for situations where the consent of the data subject does not need to be obtained; (ii) adopting an automated decision, including profiling; (iii) carrying out processing activities necessary to fulfill a legitimate interest of the Operator. in case of unjustified opposition, the Operator is entitled to further process the Personal Data. If, during the duration of the Contract, the Data Subject exercises his right of opposition repeatedly and unjustifiably, the Operator reserves the right to stop responding to such requests. The right of opposition will not be able to be exercised regarding the processing of Personal Data necessary for the execution of the Contract; h. the Data Subject's possibility to request the Operators not to be the subject of a decision based exclusively on automatic processing, including the creation of profiles, and which produces legal effects concerning the Data Subject or affecting him to a significant extent. Regarding the adoption of a decision based exclusively on automatic processing, the Data Subject has the possibility to express his point of view, to request the intervention of a human operator, as well as the possibility to contest such a decision, through the methods described herein information; i. the right to file a complaint before the National Authority for the Supervision of Personal Data Processing (ANSPDCP); j. the right to go to justice.
The data subject may exercise the rights provided for in letters a)-h) above, as follows: may submit to the Operator-Supplier a written request, dated, signed and sent by post to the registered office indicated in this Information;
We inform you that the Personal Data will be processed by the Operators in compliance with all the rights of the Data Subjects, as well as by applying appropriate technical and organizational measures to protect them against illegal or unauthorized access. These measures may consist of limiting access to data, encryption or anonymization of Personal Data, storage on secure media, etc.
